Venusnap Terms and Conditions

1. Introduction

Welcome to Venusnap. Venusnap is a product of Quixnes, a technology company dedicated to building innovative digital services. These Terms of Service ("Terms") govern your access to and use of Venusnap's photo sharing and viewing platform and services ("Services"). By using Venusnap, you agree to be bound by these Terms and our Privacy Policy

These Terms apply to all visitors, users, and others who access or use the Service.

If you do not agree with any part of these Terms, you must not use our Service.

Please read these Terms carefully before using our Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. You are advised to review these Terms periodically for any changes.

2. Definitions

For the purposes of these Terms:

• "Service" refers to the website and all services provided by us.
• "User" refers to anyone who accesses or uses our Service.
• "Content" refers to all text, images, videos, and other materials available through the Service.

3. Eligibility

You must be at least 13 years old to use Venusnap. By using our Services, you affirm that you meet this age requirement and have the capacity to enter into a legally binding agreement

4. Account Registration

You are required to create an account to access certain features of Venusnap. You agree to provide accurate, complete, and updated information during registration. You are responsible for safeguarding your account credentials and agree to notify us immediately of any unauthorized use.

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent or illegal activity.

5. User Content

You retain ownership of the photos, and other content you upload to Venusnap ("User Content"). However, by uploading content, you grant Venusnap a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content on the platform for the purposes of operation and promotion.

You are solely responsible for the content you upload and any consequences of uploading it. We do not endorse or guarantee the accuracy, reliability, or legality of any User Content.

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable at our sole discretion.

6. Albums on Venusnap

Venusnap uses "Albums" as a way for users to organize and share visual content. Each Album serves as a collection of images, snaps, or visuals centered around a specific theme, identity, interest, or purpose.

• Personal Albums: For individual use — memories, lifestyle content, etc.
• Creator Albums: For artists, influencers, educators, or storytellers sharing original content.
• Business Albums: For companies and organizations to promote products, services, or brand messages.

7. Album Naming and Identity Use

Album names on Venusnap may be subject to uniqueness depending on their type.

• Must use globally unique names across the platform.
• Names that resemble existing public brands, companies, or well-known personalities may be reserved by Venusnap.
• If a name is reserved or unavailable, the user may request access by submitting a verification request, which may include identity documentation or domain/email validation.

• Can use non-unique names (e.g., "My Life", "Travel Diary").
• These are not globally reserved and can be used by multiple users.

Venusnap reserves the right to edit, restrict, or reclaim any album name that

• Impersonates a brand or public figure.
• Infringes on trademarks or copyrights.
• Violates platform policies or causes confusion.

If you represent a verified business, public figure, or organization and your desired Album name is unavailable, you may request its release by contacting [email protected] and submitting verification documents.

8. Auto-Created Albums and Personalization

To help new users start creating and sharing content quickly, Venusnap may automatically create a default Personal Album for your account using your name or profile information. This may include generating a suggested album name, description, and starter content.

You retain full ownership and control of any auto-created album. You may edit, rename, or delete it at any time.

Some auto-generated features may use AI to personalize your experience. Automated content is provided only as a convenience and may not reflect your personal views. You are encouraged to review and modify such content before posting or sharing.

By using Venusnap, you consent to the creation of such starter content for onboarding and personalization purposes.

9. Prohibited Conduct

You retain ownership of the photos, videos, and other content you upload to Venusnap ("User Content"). However, by uploading content, you grant Venusnap a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content on the platform for the purposes of operation and promotion.

• Post content that is unlawful, hateful, or infringing on others' rights
• Harass or impersonate other users.
• Use the platform for illegal activities
• Attempt to hack, disable, or disrupt the platform's functionality.
• Use automated means to access the Service without our permission.
• Collect or harvest any personal information from other users.
• Upload viruses or any other malicious code.
• Engage in any form of spamming or phishing.
• Use the Service for any commercial purpose without our consent.
• Share your account credentials with anyone else.
• Use the Service in a manner that violates any applicable laws or regulations.
• Post content that is false, misleading, or deceptive.
• Post content that is defamatory, obscene, or otherwise objectionable.
• Post content that violates the privacy or publicity rights of any third party.
• Post content that contains any unsolicited or unauthorized advertising, promotional materials, or any other form of solicitation.

10. Intellectual Property

All intellectual property rights related to Venusnap (excluding User Content) are owned by or licensed to us. You agree not to use our trademarks, logos, or content without written permission

11. Termination

We may suspend or terminate your access to Venusnap if you violate these Terms or engage in harmful conduct. You may also delete your account at any time

12. User Data Deletion

You have the right to request deletion of your personal data stored by Venusnap at any time. We comply with all applicable privacy laws, including GDPR and CCPA, and are committed to protecting your privacy.

• Account Deletion: You can permanently delete your account from the account settings page. This will remove your profile, photos, albums, and related account data from public access.
• Data Removal Requests: If you would like to request full deletion of your data from our servers, including any backup copies, please email [email protected] using the subject line “Data Deletion Request.”
• Data Deletion Timeline: After you request account deletion, Venusnap requires up to 14 calendar days to permanently remove your personal data from our active systems and backups. During this period, your data will be inaccessible to other users and will no longer be used for any service purposes. This timeframe allows us to securely and thoroughly delete your information while maintaining system integrity and complying with legal obligations.
• Retention Exceptions: In some cases, we may retain minimal data for legal compliance, fraud prevention, or dispute resolution, as required by law.

13. Payments

By using any paid features of Venusnap, including but not limited to purchasing Venusnap Points, subscriptions, or advertising services, you agree to the following payment terms:

• Billing: All payments must be made using a valid payment method accepted by Venusnap. You agree to provide accurate and up-to-date billing information.
• Non-Refundable: All payments are final and non-refundable unless otherwise required by law. This includes payments for Venusnap Points, ad services, or subscriptions.
• Authorization: You authorize us to charge your selected payment method for any purchases you make through the platform.
• Fraud Prevention: Venusnap reserves the right to cancel or suspend any transaction that appears to be fraudulent, unauthorized, or in violation of our Terms.
• Pricing Changes: We may modify pricing for any of our services at any time. Continued use of paid features after a price change constitutes your acceptance of the new pricing.
• Third-Party Processing: Payments may be processed by third-party services Stripe. By making a payment, you also agree to the Stripe Services Agreement and any other applicable terms from those providers.
• Merchant Identity: When purchasing Venusnap Points or other paid features, your payment statement may show Quixnes as the merchant or company name.
• Venusnap Points: Venusnap Points are governed by our Venusnap Points Policy.

14. Venusnap Points Policy

Venusnap Points (“Points”) are a digital currency used exclusively within the Venusnap platform. They are required to access certain features such as boosting posts, importing photos from cloud services, running Adboards, unlocking verified badges, and other creator tools. By purchasing or using Points, you agree to the following:

• Non-Refundable: All Point purchases are final. No refunds will be provided for unused Points.
• Non-Transferable: Points may not be transferred between accounts, sold, gifted, or exchanged.
• No Cash Value: Points are not redeemable for cash or any other real-world currency.
• Expiration: Points may expire after 24 months of inactivity or account closure, at our discretion.
• Abuse: Venusnap reserves the right to revoke Points and suspend accounts if abuse, fraud, or manipulation of the system is detected.
• Finality: Using Points on any feature or service is final and not reversible once the action is completed.

15. Disclaimers

Venusnap is provided "as is" without warranties of any kind. We do not guarantee uninterrupted access or that the platform will be error-free

16. Limitation of Liability

To the fullest extent permitted by law, Venusnap will not be liable for any indirect, incidental, or consequential damages arising from your use of the platform

17. Governing Law

These Terms are governed by the laws of Zambia. Any disputes shall be resolved under Zambian jurisdiction

18. Changes to These Terms

We may update these Terms from time to time. Continued use of Venusnap after changes indicates your acceptance of the new Terms
